Food retail store gets planning go-ahead at Moreton-in-Marsh

Alder King Planning Consultants have successfully secured outline planning permission for  an out of centre food retail store at Moreton-in-Marsh in Gloucestershire. This was a particularly contentious proposal given that the scheme proposed major development within the Cotswold AONB and was further complicated by virtue of a competing food retail store in the immediate vicinity of the site.

Following the award of planning permission, the Council’s decision was subject to a Judicial Review (JR) which was launched by Warners Retail on the basis that the Council had not appropriately considered information concerning the sequential test and the impact the development would have on the vitality and viability of Moreton-in-Marsh town centre.

When dismissing the JR, the Court concluded that, ‘The relevant material was before the Council so that it could properly exercise its own judgement, which it did. There is, in my view, no basis for interfering with that judgement.’

Alder King Planning Consultants are now preparing a reserved matters submission at the site for a leading food retail operator.
