The Instruction

Our planning team submitted and negotiated a full planning application for a 64 bed high quality care home on land previously identified/granted planning permission for a local centre.  Work included the preparation of a detail Retail Planning report providing evidence that there was no demand for the local centre both in terms of number of residents and from convenience operators.

Following refusal of the planning application, a subsequent instruction was received for the submission of a planning appeal.  The appeal was heard at an informal hearing.  Work involved acting as lead consultant at the appeal including preparation of Appeal Statement and supporting evidence together with managing other supporting consultants and appearance at informal hearing.

Our Approach

Despite a strong planning case, the Council refused the planning application on two grounds:

(1) departure of Local Plan by virtue of loss of identified Local Centre; and

(2) development resulting in a cramped and contrived design.

Acting alongside King’s Counsel (Paul Tucker KC), a robust case was presented by Alder King at a subsequent appeal.  An inspector agreed with our case and subsequently allowed the appeal.

A Flood Risk Sequential Approach Assessment was also prepared by our planning team following the flood zone reclassification of the site.  The assessment successfully addressed the matter which was agreed with the Council prior to appeal hearing.

Results

After receiving a refusal of planning permission from Dorset Council, Alder King advised on the strategy and prospect of obtaining planning permission at appeal.  Appeal was allowed and planning permission granted.
