Alder King Planning Consultants were appointed by Cotswoldgate Properties / Aurelian Property Finance to provide planning advice and act as Expert Witness at a combined Planning and Enforcement Inquiry against Swindon Borough Council concerning a 14 unit residential site in Gorse Hill, Swindon.
Our role incorporated initial advice and preparation of Appeal Statements, including the Statement of Common Ground and Supplemental Agreements following the adjournment of the first Inquiry. The Enforcement Notice required the demolition of five properties, which were alleged to have been constructed 2.4 metres higher than permitted, and the appeal concerned the refusal of a planning application for an alternative reduced height scheme. The adjournment allowed for an accurate as-built survey to be prepared and reviewed by our Building Consultancy team and Statements to be updated accordingly.
The Inspector agreed that the development had been constructed in accordance with the plans and quashed the Enforcement Notice whilst also granting planning permission for the planning appeal scheme. The client was able to sell the properties without any further construction work.
