The Instruction

Alder King was instructed as planning agent to prepare and submit a reserved matters application to Wiltshire Council for 50 no. dwellings in Lyneham, Wiltshire pursuant to outline planning permission on the site.

Alder King was simultaneously instructed to discharge planning conditions from the outline planning permission in accordance with the reserved matters submission.

Following approval of the reserved matters, Alder King was instructed to prepare and submit two non-material amendment applications for slight variations to the reserved matters approval, as required by the client.

Our Approach

The site is situated in the open countryside, adjacent to the settlement of Lyneham in Wiltshire. Outline planning permission for up to 50 dwellings was approved in November 2020 establishing the principle of development. In submitting the reserved matters application in October 2021, Alder King provided a robust planning case to demonstrate the submission for 50 no. dwellings was in accordance with the parameters set by the outline planning permission and associated S106 legal agreement.

The dwellings incorporated a design and materials palette reflective of the general local character, which the Council agreed represented a well-designed scheme. Following proactive discussions with the Council throughout the application process, including only minor revisions to the scheme, reserved matters approval was secured in March 2022.

While the outline planning permission and associated S106 legal agreement secured 40% affordable housing, on behalf of our client the reserved matters submission was made to include an additional 10% affordable housing (50% total). Through discussions with the Council, reserved matters approval was secured via delegated decision, with no requirement to vary the S106 legal agreement and community infrastructure levy relief was secured for 50% of the houses to be delivered, comprising all the affordable housing. 50% of the affordable houses to be delivered.

Alongside the reserved matters, Alder King submitted to discharge conditions pursuant to the outline planning permission to ensure both applications dovetailed and the approved detail was consistent.

Following approval of the reserved matters, and through discussions with the Council, Alder King subsequently submitted two non-material amendment applications to vary the approved plans and site layout which included a slight reconfiguration of a number of plots.

Results

Reserved matters approval was secured on the basis this was largely consistent with the parameters set by the outline planning permission, with the additional affordable housing provision well received by the Council.

The Council accepted the submitted detail in order to discharge planning conditions from the outline planning permission to avoid a delay in the commencement of the development.

The Council did not raise any concern with the subsequent non-material amendment applications which were approved on the basis the proposals comprised only slight changes to the reserved matters approval which did not constitute any material change.
