A series of amendments to the Town and Country Planning (General Permitted Development) (England) Order 2015 have recently been laid down before Parliament by the Government and will come into force from 1 August 2021.

The amendments reflect the changes to the Use Classes Order which took effect from 1 September 2020 and introduced the Class E (commercial, business and services), Class F1 (learning and non-residential institutions) and Class F2 (local community) Uses.

A series of transitional arrangements had been in place to cover pre-existing permitted development rights based upon the old A1/A2/A3/A4/A5 and D1/D2 Use Classes but they will end on 31 July 2021. The newly amended GDPO largely transfers the previous permitted development rights but now with reference to the new Use Classes which came into force in September 2020.

A series of other amendments are also set out within the legislation, including matters related to fire safety for Classes A, AA and the new Class MA permitted development rights that introduce new dwellings in buildings above a certain height threshold, and introduce new requirements for the Health and Safety Executive to be consulted on such matters.
